World Defends Sudanese Rape Victim Condemned to Death

An online campaign is gaining momentum to defend a 19-year-old Sudanese woman sentenced to death for murdering her husband, who she says raped her after she was forced to marry him. The story of Noura Hussein received international attention when the details of her case circulated on social media and via an online petition on Change.org. In 2016, Hussein attempted to escape her arranged marriage, but her in-laws forcibly restrained her as her husband raped her to consummate their vows. Sarah el-Hasan, a rights activist supporting Hussein’s case, told al-Jazeera:

She wouldn’t have sex with the man; he recruited some of his cousins and brought them home where they held her down while her husband raped her.

Her lawyer Ahmed Sebair said:

The following night, when her husband tried to rape her again, Hussein stabbed him with a knife and killed him.

On Thursday, Hussein’s supporters stood behind her in the Omdurman courtroom as the judge condemned her to death by hanging after her husband’s family refused financial compensation for the killing, demanding instead that she face execution. Seif Magango, of Amnesty International said:

The death penalty is the ultimate cruel, inhuman, and degrading punishment, and to apply it to a rape victim only highlights the failure of the Sudanese authorities to acknowledge the violence she endured. Marital rape… despite being a taboo… is still a common occurrence in Sudanese society.

Nahid Gabralla is the director of NGO SEEMA, which assists gender-based violence victims and survivors. Gabralla said:

In my work, I’ve seen other cases like this. The suffering of Sudanese women happens all the time. The case of Noura is different. She stood for her rights.

Magango said:

This girl is a victim. She was married off at the tender age of 16 against her will and she stood up against that and refused to be forced into marriage. The death that took place was an act of self-defence and it’s a travesty of justice that she is at risk of being murdered, being killed by the state, only for defending herself and that is something that needs to be corrected and this death penalty, this death sentence, must be revoked.

Hussein’s lawyers have just under two weeks to appeal the conviction.

The UN Human Rights Council removed Russia, which has had a moratorium on use of the death penalty since 1996. However, Saudi Arabia, a country that executed 157 people in 2015, many of them by decapitation, will remain. Saudi Arabia is an absolute monarchy in which everything and everyone is the de-facto property or “subject” of the King. They’ll set the agenda for “human rights” at the United Nations. Despicable.

This is the Church’s considered opinion on the matter:

Often, the Church interceded before the secular authority for those condemned to death, asking for mercy and leniency. Moreover, Christian moral influences fostered a negative attitude to the death penalty in people’s minds. For example, in Russia since the middle of the 18th century to the 1905 revolution, it was a rare occurrence. The consciousness of the Orthodox Church teaches us that human life doesn’t end with bodily death… that’s why the Church continues her care for those condemned to capital punishment. Abolition of the death penalty provides more opportunities for pastoral work with those who’ve stumbled and for their repentance. Moreover, it’s clear that the death penalty doesn’t have a proper educational value, it can create irreparable miscarriages of justice, and it causes mixed feelings among the people. Today, many states have abolished the death penalty by statute or they don’t exercise it in practise. Keeping in mind that mercy toward a fallen man is always preferable to revenge, the Church welcomes these steps by state authorities.

Bases of the Social Concept of the Russian Orthodox Church

This isn’t dogma… it’s a theologoumena… but a considered one in step with earlier Church practise. Tsar Nikolai I Pavlovich pardoned all but five of the Decembrist plotters… an unprecedented act for his time. Tsar Aleksandr III Aleksandrovich routinely pardoned ALL death sentences excepting only crimes against the state (the murderers of his father went to the gibbet as their crime was treason against the state). The above painting by Repin shows that St Nicholas of Myra was no fan of the death penalty either!

You can stand with the loudmouth konvertsy or you can stand with the REAL Church. I’m with St Nick… not John Whiteford! I’m not alone…

New LNR Criminal Code Excludes Death Penalty

Today, the Deputies of the LNR Peoples Soviet approved a new Criminal Code that excludes the death penalty. During discussion of the bill, deputies passed an amendment that excludes using the death penalty in the LNR. Konstantin Matsyurak, Chairman of the LNR Peoples Soviet Committee on State Security and Defence, Law Enforcement, Judicial System, Rule of Law, and Protection of Human Rights and Freedoms, told us, “The Criminal Code provides for the total confiscation of property and life imprisonment. Today, enough people die in the war. In addition, we’re moving towards entering the Eurasian Economic Union, so we need to be as close as possible to norms found in Russian legislation and codes”. The new LNR Criminal Code states, “Life imprisonment is possible for the most serious crimes encroaching on life itself, as well as for especially serious crimes against public health and morality, public security, and sexual abuse of minors under 14-years-old. Women, juvenile criminals (under 18-years-old), and men over 65-years-old are exempt from life sentences”.
